Since approximately 2005, Liberty Commons Condominium Trust, commonly known as “Liberty Commons,” has been hijacked by a minority group of unelected and self-appointed individuals who have continuously violated their fiduciary obligations to each and every Unit Owner of Liberty Commons Condominium Trust.

LibertyCommons.Info is a self-funded resource and its goal is to provide a collaborative and collective voice for Unit Owners and residents of Liberty Commons, a 132 unit condominium development located along the north side of Old Mill Road between Jungle Road and Willard Street in Leominster, Massachusetts. LibertyCommons.Info was created to efficiently communicate amongst each other to enhance the community on matter of common interest, make a positive impact, allow individuals to get involved, share ideas, be informed, and to foster a cohesive, diverse, and inclusive “community.” All of these objectives can be achieved through the majority of Unit Owners collectively working together with the common goal to influence intelligent business decisions, ensure sound fiduciary responsibility is used in every decision and comprehensive due diligence is conducted, by always conducting ourselves with full transparency, and being fair and treating for all Unit Owners equally.

Unit Details

In an effort to properly represent each Unit at Liberty Commons from the misrepresentations of some realtors, property managers, or leasing agents, the following table was complied from the legal definitions contained within the legal documents of the Unit Deeds and Master Deed of Liberty Commons Condominium Trust, as recorded in the Worcester Country North Registry of Deeds.

General Information

  • Unit Types 1 an Inside One-Bedroom Garden Style Unit (1 floor), Unit Type 2 an End One-Bedroom Garden Style Unit (1 floor), and Unit Type 3 an End Two-Bedroom Garden Style Unit (1 floor) are all ground level Units that have a Unit Type 4 an Inside or End Two-Bedroom Townhouse Unit (2 floors) that are situated above them.
  • Liberty Commons began construction in December of 1994 and was completed in August of 1997.
  • All Units were rented by the developer through Liberty Rental Corporation from 1995 until the Spring of 2002 when individual Unit sales commenced.
  • Each Unit is allowed to have only two vehicles, per the Unit Deed, Declaration of Trust and Bylaws, and Rules and Regulations.
  • There are two Common Area Fees (a.k.a. Condo Fees), one for one-bedroom Units (Unit Types 1 and Unit Type 2) with an Ownership Percentage of 0.6850%, and the other for two-bedroom Units (Unit Type 3 and Unit Type 4) with an Ownership Percentage of 0.8239%. Common Area Fees are due and payable by the first of each calendar month.
  • Late payment of Common Area Fees (a.k.a. Condo Fees) are assessed a fine(s) between $20-$100 per month and fines are deducted before Common Area Fees.
  • The only pet that is allowed is one indoor cat per Unit, per the Declaration of Trust and Bylaws. No other pets are allowed on Liberty Commons’ property, without exception.

1 The square footage recorded in the Unit Deed is incorrect. In 2002, the developer added a bedroom to the original Unit adding an additional square footage to the living space. The median of all Unit Type 1s with a Berrington Road address is 838± sq. ft.

2 There are some slight design differences in the Gates Crossing Buildings and Units, that equates to differences in the square footage of these Units. These were the first two Buildings constructed and obviously the developer decided to made some design changes on the remaining nine Buildings at Liberty Commons located on Berrington Road.

Common Mispresentations

  • The most common misrepresentation is that “Unit Type 1” are “two-bedroom” or described as a “walk-through bedroom,” neither of which is a true nor an honest representation of the Unit. Unit Type 1s are “one-bedroom” Units.
  • Another misrepresentation is that “Unit Type 1” (i.e., lower garden-style inside) are handicapped accessible. The only handicapped accessible Units are Liberty Commons are identified in the table above and were originally designed and built with handicapped accessible entrances and exits and handicapped accessible cabinets and plumbing fixtures, per the Massachusetts Building Code at the time of construction (between 1994-1997). While a mobility challenged individual could visit these Units through the rear door to the Unit, the rear walks are not shoveled in the winter months. That was a decision make by the Board of Trustees and Managing Agent. Snow and/ or ice has never been removed from rear walks, as it would be cost prohibitive for the Association (i.e., each and every Unit Owner) to absorb these operating expenditures.
